Joe Gullo Digital B.V. ("www.joegullo.com") owns and operates this website. This document governs your relationship with www.joegullo.com (the "Website").

Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions, and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by me from time to time. You should check this page regularly to take notice of any changes I may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and I reserve the right to withdraw or amend the Services without notice. I will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, I may restrict access to some parts or all of this Website.

Prohibitions

You must not misuse this Website. You will not:

Breaching this provision would constitute a criminal offense and Joe Gullo Digital B.V. will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

I will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Free tools

The accessibility scanner, glossary, and statement generator are provided "as is" without warranty of any kind. The scanner produces machine-generated findings that may contain false positives and false negatives — it is a starting point, not a substitute for a documented audit by a qualified consultant. The statement generator produces draft language that you must review with counsel before publishing.

A clean automated scan does not certify your site as conformant. Use of these tools does not create a consulting relationship between us.

Intellectual property

The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remain the property of Joe Gullo Digital B.V. or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Joe Gullo Digital B.V. and its licensors.

You may store, print, and display the content supplied solely for your own personal use. You may quote up to 200 words for editorial or commentary purposes with clear attribution and a link back to the source. Your content

If you submit content to me through a form (a project description, a comment, a question), you retain ownership but grant me a non-exclusive license to use the content for the purpose of replying to you. I won't publish your inquiry without your written permission.

Disclaimer of liability

The material displayed on this Website is provided without any guarantees, conditions, or warranties as to its accuracy. Unless expressly stated to the contrary, to the fullest extent permitted by law, Joe Gullo Digital B.V. and its suppliers, content providers, and advertisers hereby expressly exclude all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity, and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, data, or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance, or failures of this Website.

My total aggregate liability for any claim arising from this Website or the free tools is limited to €100 or the amount you paid me in the 12 months preceding the claim, whichever is greater. This limitation does not apply to liability that cannot be limited under Dutch law (e.g., death, personal injury, fraud, or intentional misconduct).

Consulting engagements are governed by their own Statement of Work, which contains its own liability terms. Those terms supersede this section for matters related to the engagement.

Changes to these terms

I may update these terms from time to time. The "Last reviewed" date at the top tells you when. Material changes will be flagged on the newsletter and via a notice on the site for 30 days. Continued use after a change means you accept the updated terms.

Governing law and jurisdiction

These terms are governed by the laws of the Netherlands. Disputes that cannot be resolved by direct discussion are subject to the exclusive jurisdiction of the courts of The Hague, Netherlands.

If you are a consumer (not a business), this clause does not deprive you of protections you have under the mandatory consumer protection laws of your country of residence.

Severability

If any provision of these terms is found unenforceable, the remaining provisions stay in effect.
